Terms & Conditions for the Recipe for Success viewer competition

These Terms and Conditions will govern your participation in the Recipe for Success Viewer Competition. You are deemed to have read and consented to these terms and conditions before entering this Competition. All participants during the term of this Competition agree to be bound by the following terms and conditions:

    1. The Sponsor of the Competition is Samsung Electronics South Africa (Proprietary) Limited, Registration number: 1994/003872/07 and/or its agencies, with NBB Productions CC, Registration Number: 1999/039270/26 being the Organizer of the Competition ("Organizer").
    2. This Competition is not open to directors, members, partners, agents, employees, consultants of the Organizer or sponsors or any direct family member of the aforementioned parties, being spouses, life partners, business partner, parents and children, natural and adopted, siblings. In the case of any dispute or uncertainty the Organizer’s decision shall be final and binding.
    3. The Competition is also subject to Terms and Conditions of Capsicum as set out hereinafter and in the case of any contradiction or uncertainty the decision of the Organizer in its sole and absolute discretion shall be final and binding on all parties.
    4. At the end of the competition one winner shall be chosen from the entire database of entries to win the following prize:

  1. The total recommended retail value of these prizes are almost R250 000.00, which amounts are only recommendations and subject to the Organiser’s sole and absolute discretion and are not binding on any party. The Organizer, sponsors and all other parties involved shall not be liable in any way whatsoever for any inaccurate prize details whatsoever and participants will have no claims of any nature whatsoever in such event.
  2. The Organizer and the sponsors reserve the right to vary, suspend or cancel any of the prizes or any aspect thereof in their sole and absolute discretion and will not be liable in any way whatsoever and participants will have no claims of any nature whatsoever in such event.
  3. Participants can enter via sms or on the recipe for success website www.recipeforsuccess.tv to qualify for the grand prize; participants must provide the right answer of one of the viewer’s competition questions.
  4. Sms cost R 1.50 per SMS and participants can enter as many times as they wish. Free minutes do not apply.
  5. It is the responsibility of participants to ensure that all information provided is accurate, complete and up to date. The Organizer, sponsors and all other parties involved shall not be liable in any way whatsoever for any errors caused by incorrect details whatsoever and participants will have no claims of any nature whatsoever in such event.
  6. The Competition will run from 13-09-2016 to 04-12-2016 (“the Competition Period”). The duration of the Competition may be cancelled, extended or curtailed at the sole and absolute discretion of the Organizers.
  7. The competition closes on Sunday the 4th of December at midnight after which no further entries will be accepted. The Organisers takes no responsibility for any entries not received for any reason whatsoever and participants will have no claims of any nature whatsoever in such event.
  8. The winner will be announced right after the last episode on the 6th of December 2016 and the Organizer’s decision is final.
  9. One winner will be selected from the overall entries, with an auditor present, using www.random.org - a random number generator - to draw a name, subject to the terms and conditions of the viewer competition.
  10. A winner will be drawn at random using www.random.org - a random number generator - on 5 December 2016 and the winner will be notified by the Organizer on the same day as the aforementioned draw.
  11. Before the 31 of January 2017 a representative from Aramex will contact the winner telephonically to identify a suitable date for delivery of the prizes.
  12. Before the 31 of January 2017 a representative from each of the companies represented in the competition will contact the winner telephonically to identify a suitable date for delivery of the prizes. The Organizer may request that you provide such additional information and documentation as it in its sole and absolute discretion deem necessary. Any failure to provide same will result in immediate disqualification.
  13. All participants must be citizens of the Republic of South Africa and/or a permanent residents of the aforesaid country, must be currently residing in the country at the date of the commencement and for the duration of the Competition Period, and must be at least 18 (eighteen) years old at the date of the commencement of the abovementioned Competition.
  14. In the event that the winner is unreachable, disqualified or fails to claim the prize, the prize shall be forfeited to another winner based on the same terms and conditions. The Organizer’s decision in it’s sole and absolute discretion in this regard shall be final.
  15. Entry to this Competition does not make any participant a winner.
  16. Prizes are not transferable and the winner may not substitute the prize for cash, subject to the sole and absolute discretion of the Organizer.
  17. Information regarding the Competition that is published on authorized advertising material will also form part of the terms and conditions of the Competition.
  18. Participants agree that that their details may be used by the Organizers, In accordance with the confidentiality policies and practices of the Organizers, for any purposes regarding the Competition and the Programme. Details of participants will only be used by the Organizer unless the participant’s opt-in to receive further communication from the Organizers.
  19. The Organizer’s may in their sole and absolute discretion stop, cancel or amend the competition and these terms and conditions at any time, without notice, and such amendments shall be deemed to have taken effect from the date of publication of the revised terms and conditions.
  20. The Organizers reserves the right in to cancel, suspend, change or terminate this Competition or any of the prizes in their sole and absolute discretion, without notice at any time and the Organizers or the sponsors or third party shall not be liable in any way whatsoever in event of such cancellation, suspension, change or termination. The participant waives his/her right which they may have against the Organizers or the sponsors or third party and hereby acknowledge that they will have no right of recourse or claim of any nature whatsoever against the Organizers or the sponsors or third party.
  21. The Organizers exclude all warranties (express or implied), representations and liabilities regarding this Competition (other than for death or personal injury caused by any negligence and/or fraud).
  22. The participant and/or winner(s) hereby indemnifies the Organizer, sponsors and any other parties involved against any direct, indirect, special, incidental, consequential or punitive damages or loss of any kind regardless of how this was caused, and whether it arose under the law of contract or delict or otherwise, because of the participant’s entrance to the Competition, including any legal fees on an attorney and client scale incurred in defending any such claims.
  23. Any dispute or claim arising out of or in connection with the Competition shall be governed by and construed in accordance with the laws of South Africa.
  24. The Organizers, their directors, members, partners, employees, agents, consultants, any other person who directly or indirectly controls or is controlled by them or any supplier of goods and services in connection with the Competition and their spouses, life partners, parents, children, siblings, business partners or associates are not eligible to participate in or enter the Competition.
  25. Participants consent to the jurisdiction of the Magistrate’s Court in terms of Section 45 of the Magistrate’s Court Act, 32 of 1944, as amended from time to time, which has jurisdiction in terms of Section 28(1) of the said Act in respect of any action or proceeding which may be brought in connection with this Competition, notwithstanding that the value of any claim may exceed the Jurisdiction of the Magistrate’s Court.
  26. Should any participants institute any legal proceedings against the Organizer, the sponsors, their agents or any other party involved in this competition the participant agrees to pay all such parties legal fees on a scale as between attorney and client, including collection commission, tracing, valuation and expert’s fees, irrespective of whether the matter has been referred to court, which costs shall be on demand.

Capsicum Culinary Studio (PTY) LTD: Recipe for Success – Prize Description / Terms and Conditions

This bursary / prize for the Recipe to Success will include the following:

  1. Uniform set including safety shoes.
  2. Knife set applicable to the specific program.
  3. City and Guilds Examination registration / fees, excluding any re-write fees.
  4. All cooking ingredients during the program, including summative assessments.
  5. All learner material.
  6. Student Card.
  7. Student Name Badge.
  8. SACA (South African Chefs Association) Membership.
  9. Industry Placement during the program (semester) for experiential training.
  10. Graduation cost (Certificates where applicable, Invitations, ceremony).
  11. Capsicum Culinary Studio (Pty) Ltd in collaboration with NBB Productions will allow this prize to be transferred to another person but the onus will be on the prize winner as both parties, Capsicum Culinary Studio (Pty) Ltd and NBB Productions will not be held accountable or be responsible for the transfer of prize. It is the prize winners responsibility to inform NBB Productions accordingly of such changes. Terms and Conditions will still apply for such transfers.

Other terms and conditions that is very important:

  1. This prize is not convertible to cash. Capsicum Culinary Studio (Pty) Ltd offer no cash alternative for non-cash prizes and prize winners must accept prizes in the form offered.
  2. Candidate must be able to write, speak and understand English. All training will be conducted in English.
  3. Capsicum Culinary Studio (Pty) Ltd reserve the right to request proof of the prize winner’s identity, age and address. In the event that a prize winner cannot provide Capsicum Culinary Studio (Pty) Ltd or NBB Productions with proof of identity and age reasonably acceptable to Capsicum Culinary Studio (Pty) Ltd, the prize will be withdrawn and another prize winner will be selected.
  4. Travel to and from the campus where the successful candidate will study is not included.
  5. Accommodation in the region where studies will be conducted is not included.
  6. Stationery that has not been mentioned in the inclusion of the program will not be included. Most commonly used stationery items that could be required at your own expense: Pens, pencils, eraser, ruler, scissors, paper glue, writing pads for notes, NON-scientific calculator.
  7. Any re-write fees if the candidate has failed an outcome will not be included, re-writes are to the candidates own expense.
  8. Employment after completion of the program is not included.
  9. This program is not a National Certificate (qualification). This program is a City and Guilds endorsed program and is internationally recognized.
  10. Graduation cost (Certificates where applicable, Invitations, ceremony).
  11. Travelling cost for student and his/her guests to and from the Graduation is not included.
  12. Accommodation cost for the student and his/her guests for the Graduation is not included.
  13. The candidate MUST be a South African citizen with a South African ID, not a foreign person in the process of permanent residency or that has obtained residence and still await the correct documentation.
  14. The candidate must be 18 years of age.
  15. The candidate must not have any physical disability, pregnant during the training period which will prevents the candidate to work in a training kitchen or be placed in an industrial kitchen during experiential training.
  16. The candidate must be in possession of a Gr12 Certificate (Certified copy of Qualifications must be handed in during the registration process in January 2017) or have completed Gr12 awaiting results, should the results be negative, the candidate forfeits this bursary opportunity.
